I don't think abortion was legal till the 1960's at least. I'm surprised you know about an abortion from 1849, was it recorded? If in medical information then abortion could different from what we hear called abortion today, however, the medical profession still call a miscarriage spontaneous abortion (probably latin) it is just not a common term used anymore.
