Scott, have you ever seen any documented evidence before that any of the Cornwells of Prince William County moved to Frederick County before 1800? I don't remember any - I thought to ask you because I know that you're interested in that question.

I wonder how this Guardianship Bond, which I previously hypothesized as possibly referencing Elizabeth Cornwell, daughter of Charles Cornwell died 1797, fits in with the known information that Betsey Cornwell, step-daughter of Peter Wolfe, married John Graves? Any ideas?

In Prince William County, the Charles Cornwell who married Jane Howison dated his will February 27, 1797. The will was presented for probate by his widow Jane on 3 July 1797. On 5 September 1797 John Groves Sr. And John Groves Jr. posted $300 guardianship bond for Elizabeth Cornwell, Orphan.
It is also possible (and probably more likely) that this Betsey Cornwell was the Betsey Cornwell who married John Graves.

John Graves, Husband of Betsey Cornwell, Step-Daughter of Peter Wolfe

In a previous post, I reported information found in the Chancery Court Case, John Graves & Wife v. Exr of Peter Wolfe that showed that Betsey Cornwell (step-daughter of Peter Wolfe) married John Graves (and not John Wolfe, grandson of Peter Wolfe as some had previously thought).

In Chancery Court Case, Francis Graves (alias: John Graves) v. Dev(s) of Marquis Calames (Calmes), John Graves Sr. sued the Heirs of Marquis Calmes over land that was in the Shenandoah Valley, in the part of Frederick County that eventually became Clarke County. This means that this John Graves was a near neighbor of Peter Wolfe.

Contained in this case was a deposition of John Graves Jr. who identified John Graves Sr. as being his father, and who identified himself as being about thirty three years old in 1800. I believe that this John Graves Jr. was likely the John Graves who married Betsey Cornwell, step-daughter of Peter Cornwell.

In the same folder as the Tabb Family Bible transcript at the Library of Virginia was the Bible of the John Graves Family. Among other entries, was the following:

John Graves, son of John and Sussana Dicken Graves, born December 19, 1737.

Ann Rice, daughter of William and Sara Nelms Rice, born November 21, 1741.

John Graves, son of John and Ann Graves, born January 19, 1767.

This last entry may refer to the husband of Betsey Cornwell, who if 33 years old in 1800, would have been born in 1767.

There are many other entries in this Bible pertaining to the families of John Graves and Ann Rice; William Willis and Elizabeth Garnett m. November 25, 1760; and Reuben Graves, son of John and Ann Graves, and Elizabeth Willis, daughter of William and Elizabeth Willis, married January 7, 1808. It would be too time-consuming to transcribe these entries here, however; anyone who wishes more information about them may contact me at elaine.crockett@verizon.net.

To the worshipful county court of Fredrick now sitting in chancery your orator William Cornwell (son of William) respectfully sheweth that some time in the month of May last Wm. McCormack a deputy sheriff of the county came to your orator's house for the purpose of executing a writ issued from the office of this court in the name of Timothy Brundige against one William Cornwell, he the said deputy sheriff having supposed that your orator was the person against whom the said writ was issued, that your orator assured the said Sheriff that he knew nothing of the transaction that he had not been a resident in the county of Prince William where the debt was said to have been contracted since the year 1795 and that he knew other men of his name residing in this county and elsewhere, your orator never having signed his name to any obligation but the ? herein mentioned whatever and never having before been sued in any court, and being perfectly ignorant of the proceeding in? courts of justice concluded after such representation had been made to the office, that there was no danger of his being put to justice traceable about it, until lately when he has discovered that a judgment has been attained against him and execution issued thereon and he is? compelled to give a delivery bond altho he solemnly swears? that he was not the person liable to the action never had seen or heard of the plaintiff, knew nothing of the transaction.

Your orator begs leave to refer to the proceeding in said suit part of this bill from which it will appear that said suit and judgment was founded upon a record of a judgment rendered in the county court of Prince William on the 5th day of October 1801 against William Cornwell the son of Ezekiel, that there were a number of the name of William Cornwell in the county of Prince William when your orator left that county which was in the (year?) 1795, and that when your orator moved from said county that William Cornwell, son of Ezekiel, who is the person named in the said record continued to reside in said county and your orator has heard and believes that he has since moved to the county of Harrison? your orator therefore prays this court to grant him an injunction to stay all further proceeding, upon said Judgt & delivery until the matters herein contained can be heard in equity & to grant to your orator such other & further (relief?)

Frederick County to wit, this day William Cornwell the son of William the plaintiff in this bill made oath before me a justice of the peace in and for the said county these the facts contained in the annexed bill are true to the best of his knowledge and belief given to before me this 2nd December 1816.

L.M.
Thanks so much for posting these, Elaine. This is great information. I'm hoping to have more time to study it in the next week or so. The William that was the son of Ezekiel appears to have been in Prince William Co, VA until 1804 when he last appears in the personal property tax records as William Cornwell, Jr.

State of Tennessee
Jefferson County

This day personally appeared before me Joel R. Denton one of the acting Justices of The Peace, in and for the County of Jefferson aforesaid William Cornwell a reputable witness aged eighty two yr and who being duly sworn, on the holy evangelist of Almighty God, Deposeth and Saith that during the Revolutionary War, he lived in Pittsylvania County in the State of Virginia, was himself a Private in the State or Milititia (sic) Service against the Common enemy that in the year 1778 he became acquanted with Captain Johnathan Langdon, in the Service of the United States in the Continental line of the State of Virginia (does not know what Regiment) at that time he was in Service near Richmond Virginia, he saw him at different and repeated periods during that year, and in the Service of his country as a captain had the command of a company and in the year 1779 this affiant served two tours of duty as a Private in State or milititia (sic) service, and did not see or know any thing of said Langdon during that year, and afterwards (illegible) in the latter part of the year 1780 this affiant with several others volunteered and left home with the intention to join Genl. Morgan against the Brittish (sic), and after several days march, we found that it was impossible to accomplish our object, without a very great resque (sic) of loosing our lives, this affiant with his companions, concluded to return home and on their way back the affiant saw Captain Johnathan Langdon and recognized him as the same person he had seen in service before near Richmond Virginia, he had a broken leg, which this affiant then understood had been broken after days days (sic) before, and while he was in Service, which was in the month of December 1780. Captain Langdon regretted much his situation, & said he would return to the service as soon as he was able he supported? a good character and died in the county of Jefferson some years since.

Sworn to & subscribed before me the 3rd day of March viz 1834

(Signed) W Cornwell (looks like the signature of a very
old man)

Joel R.
1797 Diary of Thruston Family Tutor Mentions Betsey Cornwell, Frederick County, VA
Sun June 25 1797 Clear & very warm today went to See Robert Newman Betsey Cornwell left Mr. Taits today.

Spelling and Punctuation in Original.

Source: Frederick County, VA Diary 1795-1799 of Tutor and Miller who worked for Charles Mynn Thruston of Mt. Zion, Frederick County, Virginia.
Original Diary
College of William & Mary
Earl Gregg Swem Library
Special Collections Room
Williamsburg, Virginia

My notes: First, I would note that currently we have not determined the identity of the diary's author (the name of the author doesn't appear in this extremely old and very tattered book). However, we do know from reading the diary's entries that this man worked for Charles Mynn Thruston in Thruston's mill and that he also kept a school attended by local children, including those of Charles Mynn Thruston.

I would also note that - despite being a teacher - the diary's author seldom used commas, periods, or other punctuation, important because placement of punctuation changes the various possible meanings of the entry. For example, this entry could mean that the author went to see Robert Newman, (then) Betsey Cornwell and (later) the author left Mr. Tait's. Or the entry could mean that the author went to see Robert Newman and that Betsey Cornwell left (Mt. Zion) that day and that the author was seeing Mr. Tait later that day. Or, the entry could mean that the author went to see Robert Newman and that Betsey Cornwell left Mr. Tait's (house) that day.

I have looked at the above entry in detail because I think it possible that this entry refers to Betsey/Betty Thornton who married Charles Cornwell in 1796.

I descend from Essex Cornwell's. William Cornwell of Terling parish married Joan Ranke in 1632 in Fairsted parish. His father was probably William Cornwall and Joan Martin his mother. They were married in Terling Parish in 1602. The father of William Sr seems to be George who married Joan? they both from Fairsted Parish.
the William who married Joan Ranke came to Roxbury about 1633 and has been mentioned in this message board previously.
do you connect to these same English ones mentioned?

I haven't been able to find out who keeps the records on this church. If you know could you let me know? I just found out my Gr-Gr-Gr Grandmother is buried there according to her death certificate. I have been there several times I'm sure my Gr-Gr-Gr Grandparents don't have headstone but I don't know where to go for the records. The cemetery was in bad shape last year. Anyone going there should have someone with them because there are graves with holes and you have to watch where you step. It looks as though the cemetery is bigger because there are graves in the woods. I would love to find a genealogy group that is willing to clean it up, i'd help for sure. The DAR did a survey in 1954 and printed a book but you can't find a copy, out of print. Thanks for any help you can give me. Judy L.

Proof That Simon Cornwell Did Not Marry Molly Johnson

Files in the 1817 Chancery Court Case Rep(s) of Tunis Johnson v. Yellis Johnson, etc., contain the Will of Tunis Johnson, dated 1807. In pertinent part the will states:

"I have heretofore put into the possession of my daughter Rebekah Carter, decd that the same may go and be inherited by my grand son John A. Carter, the son of my Daughter Rebekah."

In addition, in Tunis Johnson's will, he names his daughter Agnes Duncan, who was the wife of Howsen Duncan.

Notice the marriage bond entry in John P. Alcock's Fauquier Families, p. 59:

Carter, John. 96H/Simon Cornwell. MB June 4, 1796 to Rebecca Johnson. bd Howsen Duncan.

It is clear to me that anyone who has relied on the above entry to prove that Simon Cornwell married Molly Johnson (which, if I'm not mistaken, is what has happened) has in fact been misreading the entry. Taken together with the will of Tunis Johnson naming his grandson, John A. Carter, son of Rebecca Johnson Carter and the fact that Howsen Duncan married Agnes Johnson, sister of Rebecca Johnson, proves that the Rebecca Johnson of the marriage bond was the daughter of Tunis Johnson and that this marriage bond was issued in connection with her marriage to John Carter.

Further, the will of Moses Johnson/Johnston discussed in my earlier post, naming daughter Molly Johnson in 1804 at which time Simon Cornwell was known to have been married to a Phebe (1804 deed), proves that this Molly Johnson did not marry Simon Cornwell, otherwise, she would have been referred to in the will and the court documents contained in the file as Molly Cornwell and Simon Cornwell's wife would have been referred to as Molly in the 1804 deed.

Source: Will of Tunis Johnson contained in files of Chancery Court Case: Rep(s) of Tunis Johnson v Yellis Johnson, etc., Fauquier, Virginia, Index No. 1817-018
Fauquier, Library of Virginia

I would say yes. It actually listed two Joseph Wrights. When we transcribe documents, we try to transcribe them exactly as they are written. However, as mistakes can always be made, your best bet is consulting the original. Since we got this from microfilm, we no longer have it.

Re: Evidence that Simon Cornwell Did Not Marry Molly Johnston in 1796, Fauquier County, Virginia

As to the last point, here is a relevant entry in John P. Alcock's book, Fauquier Families, 1759-1799, p. viii.

"He, him, and his always refers back to the person in the heading of the entries rather than who would be antecedent under normal grammatical rules: For example: Simon Cornwell M8-302, 1787. Suit ag. Francis Watts abates due to his death (Cornwell's not Watts.)

To me, this seems clearly to state that a Simon Cornwell who lived in Fauquier was dead by 1787. Accordingly, there must have been another, different, Simon who sold land in 1804 and who was the named executor of Moses Johnston's estate.

I do think that the Simon, with wife Phebe, who sold land in 1804 was the Simon Cornwell who was named as executor of Moses Johnston's will because in 1806, the Commissioners filed another report and Simon's name was no longer listed among them, indicating that he had likely moved from the area.

Evidence that Simon Cornwell Did Not Marry Molly Johnston in 1796, Fauquier County, Virginia

I know that there was a marriage bond for Simon Cornwell June 4, 1796 to Rebecca Johnson bd Howsen Duncan; however, the common consensus (at least as far as I can determine via the internet) seems to be that this Rebecca Johnson is the Molly Johnston/Johnson, daughter of Moses Johnston dec. circa 1803.

I would proffer that this is not correct; my evidence is twofold: First, the court case of Moses Johnson v. Duanna Johnson, discussed below. In the will of Moses Johnson and in the court case, filed in 1804, nowhere do the complainants or respondents call Molly Johnston by the name of Molly Cornwell, which would have been her name if she had married Simon Cornwell in 1796. In fact, the court itself in its order refers to Molly as Molly Johnston.

Second, in November 1804, Simon and his wife, Phebe, sold land in Fauquier. Neither of these fact make sense if Simon had already married 1796 Molly, daughter of Moses Johnston. Therefore, I think that Rebecca Johnson of the 1796 marriage bond must be a different woman than Molly Johnston, daughter of Moses Johnston and Duanna Shumate.

A separate but related question - Has anyone else ever wondered whether there were two different Simon Cornwells living in Fauquier during the same general time frame and whether these two Simons have been confused as being one and the same person?

Please feel free to offer any suggestions, corrections, or counter-proposals!
